TO RESPOND TO COMPLAINT 1 Plaintiff commenced this action with the Complaint filed April 2, 2018. Plaintiff served 2 Defendant with the Complaint on April 18, 2018. Defendant’s response is currently due on May 9, 3 2018. 4 In the interim, on April 26, 2018, Defendant served Plaintiff with correspondence which 5 6 Defendant contends demonstrates that Defendant is not a proper party to this action. Specifically, 7 Defendant contends this correspondence attached documentation demonstrates that it did not (1) 8 manufacture, (2) place into the stream of commerce, or (3) assume any liabilities related to the design, 9 manufacture, or marketing of the subject grinder. Under applicable law, the facts outlined in this 10 correspondence—if true—preclude any liability on the part of Defendant as a matter of law. 11 12 So as to (1) allow Plaintiff a meaningful opportunity to investigate the accuracy of the 13 documentation provided by Defendant, and (2) correspondingly allow the Defendant in the interim to 14 forgo further litigation expenses, including those associated with engagement of local counsel, the 15 parties stipulate and jointly request that the Defendant’s response to the Complaint will—subject to 16 the Court’s approval—now be due on July 8, 2018. 17 18 19 20 21 22 23 24 DATED this 8th___ day of May, 2018 DATED this _8th___ day of May, 2018 /s/ Samantha A.
