On March 19, 2024, Plaintiff filed a Second Amended Complaint. See ECF 90. 23 2. On April 18, 2024, Defendant Leaphigh Animals, LLC filed a Motion to Dismiss 24 the Seventh, Eighth, and Ninth Counts of Plaintiff’s Second Amended Complaint (the “Motion 25 to Dismiss”). See ECF 91. 26 3. The Court previously entered an Order approving the parties’ Stipulation to extend 27 the deadline for Plaintiff to file its Response to Defendant’s Motion to Dismiss from May 2, 2024 28 to May 16, 2024. See ECF 93. 1
