File First Amended Complaint

Plaintiff Sergey Mkhitaryan, through his counsel of record Assistant Federal

2

Public Defenders Stacy M. Newman and Alicia R. Intriago, now ask for an additional

3

30 days from January 9, 2025, up to and including February 10, 2025, in which to file

4

the first amended complaint.

Since counsel was reappointed to this case on October 7, 2024, counsel has met

6

with Mr. Mkhitaryan in person twice—first on October 25, 2024, and again on

7

November 22, 2024—to discuss the goals of the litigation and possible claims in an

8

amended complaint. Since their last in-person visit, Mr. Mkhitaryan has been

9

undergoing competency proceedings with his next court date set for January 22, 2025,

10

in the Eighth Judicial District Court to determine whether he is indeed competent to

11

proceed with his state criminal proceedings.

12

Currently the amended complaint in the instant case is due January 9, 2025.

13

Counsel therefore asks for an additional 30 days to file an amended complaint in

14

order to meet with Mr. Mkhitaryan in person to discuss the possible claims in the

15

amended complaint. This request for more time is not made for the purposes of delay

16

but in the best interests of Mr. Mkhitaryan.
