The CAR to Plaintiff’s Complaint is 24 25 Carolyn Colvin became the Acting Commissioner of Social Security on November 30, 2024. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Carolyn Colvin should be substituted 26 for Martin O’Malley as the defendant in this suit. No further action need be taken to continue this suit by reason of the last sentence of section 205(g) of the Social Security Act, 42 U.S.C. § 405(g). 1 1 due to be filed by January 6, 2025. This is Defendant’s first request for an extension of time. 2 Defendant requests this extension because Defendant has been notified that the CAR is not yet 3 available, and that additional time is needed to prepare it. Defendant therefore cannot respond to 4 Plaintiff’s Complaint. Once the CAR arrives, Defendant will need to review it for defects before 5 submitting it. 6 7 8 9 10 11 12 For these reasons, Defendant requests an extension in which to respond to the Complaint until February 5, 2025. On December 17, 2024, the undersigned conferred with Plaintiff’s counsel, who has no opposition to the requested extension.
