The Petition of the United States Board of Water Commissioners and the Chief Deputy

Water Commissioner for Approval of Budget and Approval of Rate of Assessment for the Year July 1,
22
2015 Through June 30, 2016, and for Approval of the Audit Report for the Year Ended June 30, 2014

(“Petition”) (Doc. 1317) was filed on April 10, 2015.

A hearing was set for May 29, 2015 (Doc. 1322). The Court ordered that if no objections
were filed by May 15, 2015, the Court would consider vacating the Hearing (Doc. 1322).

The Walker River Paiute Tribe (“Tribe”) and the United States of America (“United
27
States”) filed Joint Comments on May 15, 2015 (Doc. 1333). The Walker River Irrigation District
28
(“WRID”) filed a Response to the Joint Comments on May 15, 2015 (Doc. 1334). The Joint Comments

of the Tribe and the United States state their comments are similar to their comments filed annually with
2
the Court in prior years, and that therefore a hearing may not be required. Subject to the statements
3
made in their comments, the Tribe and United States did not object to the Court approving the Petition.

The Joint Comments largely pertain to a concern that the delivery of water to the Tribe account for
5
conveyance losses and accuracy of measurement. The Tribe and the United States do not object to the
6
United States Board of Water Commissioners administering the Decree and the delivery of water in the
7
same manner as in prior similar irrigation seasons. WRID responded to the Tribe’s and United States’
8
Joint Comments and acknowledged that the Tribe and the United States have not waived the rights they
9
may have to seek in the future a difference place of measurement and/or to the addition of water to offset
10
conveyances losses, if any.

There were no other comments or objections filed to the budget, rate of assessment or
the audit report.

The Court having considered the Petition, the Tribe’s and United States’ Joint Comments,
14
WRID’s response, the proofs of notice, and being fully advised in the premises makes the following
15
findings:
16

The Court finds that notice of this hearing has been given by publication and
17
posting of the Notice of Filing of Report and Petition for Approval of Budget and Approval of Rate of
18
Assessment for the Year July 1, 2015 Through June 30, 2016, and for Approval of the Audit Report for
19
the Year Ended June 30, 2014 in accordance with its Order of April 13, 2015 (Doc. 1323), and that
20
additional notice has been given by electronic service and by mailing a copy of the Petition, the
21
(Proposed) Order Requiring Notice and (Proposed) Notice of Filing Report on April 10, 2015, as set
22
forth in the Affidavit of Service filed on April 10, 2015 (Doc. 1320).

The Court finds that the Budget and Rate of Assessment for the year July 1, 2015
to June 30, 2016 should be approved.

3.
The Court finds the Audit Report of the accounting records of the United States
26
Board of Water Commissioners for the year ended June 30, 2014, prepared by Arrighi, Rader & Blake
27
LLC, Certified Public Accountants, should be approved.

NOW, THEREFORE, it is hereby ordered that:

The Budget and Rate of Assessment of $3.10 per acre for the year July 1, 2015
3
to June 30, 2016 submitted by the Chief Deputy Water Commissioner and approved by the United States
4
Board of Water Commissioners on March 26, 2015 is hereby approved; and
5
2.
The Audit Report of the accounting records of the United States Board of Water
6
Commissioners for the year ended June 30, 2014, prepared by Arrighi, Rader & Blake LLC, Certified
7
Public Accountants, is hereby approved.
