ORDER REGARDING PRELIMINARY INJUNCTION. IT IS ORDERED that defendant Riverwood, its officers, etc. are restrained and enjoined during the time period from 01/08/2010 to 01/07/2011 from foreclosing on the property that is at issue in this lit igation and from proceeding with or taking any further action in regards to Trustee Sale No. 2386968-RMD or the Notice of Default and Election to Sell Under Deed of Trust recorded on or about 09/11/2009. FURTHER ORDERED that plaintiff is require d to post a bond for the first forty-five (45) days of the time period for the Preliminary Injunction in the amount of $50,000.00. Said bond must be posted by 01/29/2010. FURTHER ORDERED that, as a condition to the continuation of the inju nction, plaintiff is required to increase the amount of the bond to the total sum of $650,000.00 by 02/22/2010. The amount of the bond is conditioned for the payment of such costs and damages as may be incurred by Riverwood if found to have been wrongfully enjoined or restrained. If the bond is not posted, the foreclosure sale can go forward as to be advertised. FURTHER ORDERED that the parties shall appear on 02/05/2010 10:00 a.m. to discuss the conditions, if any, to be placed upon the defendant as a condition precedent to the requirement of the plaintiff posting the $650,000.00 bond.
