(Doc #153.) Brito has not 3 appeared in this action, no action has been taken against Brito since entry of Clerk’s Default on 4 January 29, 2010 (#64), and Plaintiffs represent they have chosen not to pursue a default judgment. 5 Furthermore, all claims in this action have been adjudicated as to all defendants except Brito. On 6 November 4, 2011, this court issued an Order (#148) granting in full State Defendants’ Motion to 7 Dismiss. Furthermore, on November 8, 2011, this court issued an Order (#149) granting in full 8 Carson City Defendants’ Motion for Summary Judgment. 9 IT IS THEREFORE ORDERED that Plaintiffs’ motion for voluntary dismissal of all claims 10 against Defendant Marcos Brito (#153) is GRANTED.
