ORDER. IT IS ORDERED that the 15 motion to remand is DENIED. FURTH ORD that the 14 motion to stay, 10 motion to dismiss, and 11 motion to dismiss are DENIED as moot. FURTH ORD that the 39 motion to dismiss and the 41 motion to di smiss are GRANTED in part and DENIED in part. All claims before the Court are dismissed except the claim for injunc relief based on statutorily defective f/c.
