In this capital habeas corpus action, the respondents filed their answer on
13
July 24, 2023 (ECF No. 185). On May 24, 2024, Petitioner Robert McConnell,
14
represented by appointed counsel, filed a reply to the answer and a motion for
15
evidentiary hearing (ECF Nos. 191, 193). The respondents were due to file a response
16
to the reply and a response to the motion for evidentiary hearing by September 23,
17
2024. See ECF Nos. 91, 195.

On September 23, 2024, Respondents filed a motion for extension of time (ECF
19
No. 196), requesting a 45-day extension of time, to November 7, 2024. Respondents’
20
counsel states that the extension of time is necessary because of their obligations in
21
other cases. Respondents’ counsel represents that McConnell does not oppose the
22
motion for extension of time. The Court finds that the motion for extension of time is
23
made in good faith and not solely for the purpose of delay, and that there is good cause
24
for the extension of time requested.
