ORDER. IT IS HEREBY ORDERED that Plaintiff's 1 application to proceed in forma pauperis is GRANTED. Plaintiff shall not be required to pay an initial filing fee; however, even if this action is dismissed, the full filing fee mu st still be paid. FURTHER ORDERED, the Washoe County Detention Facility shall pay to the Clerk of the USCD, District of NV, 20% of the preceding month's deposits to the plaintiff's account until the full $350 filing fee has been p aid of for this action. The Clerk shall SEND a copy of this order to the attention of the Accounting Clerk, Washoe County Detention Facility. Clerk shall further send copy of this order to the Chief of Inmate Service for the NDOC, for refere nce should plaintiff be transferred to the custody of the NDOC. (Sent: 11/1/2010.) FURTHER ORDERED, the Clerk shall FILE the complaint ( 1 -1). FURTHER ORDERED, that defendant Jackson and Washoe County are DISMISSED from this action with prejudice for failure to state a claim upon which relief can be granted. FURTHER ORDERED, all claims in count one are DISMISSED for failure to state a claim upon which relief can be granted. FURTHER ORDERED, count two i s DISMISSED for failure to state a claim upon which relief can be granted. FURTHER ORDERED, plaintiff is GRANTED thirty (30) days from the date of service of this order within which to file an amended complaint remedying the deficiencie s identified herein this order. FURTHER ORDERED, should plaintiff not timely file an amended complaint in compliance with this order, this case will be dismissed in its entirety. Signed by Judge Larry R. Hicks on 10/28/2010.
