ORDER. IT IS ORDERED that the 3 Motion to Remand is DENIED. FURTH ORD that the 16 Motion to Dismiss and the 7 Motion for Summary Judgment are GRANTED in part and DENIED in part. All claims are dismissed except the claim for injunc relie f due to statutorily defective f/c. FURTH ORD that Ds will not transfer or lease the Property or take any action to evict P from the property for 100 days. During this period, P will make full, reg pymts un the note every 30 days, w/the 1st pymt due 10 days after the date of this order. Failure to make monthly pymts will result in a lifting of the injunc. FURTH ORD that during the injunc period the parties will engage in the state f/c mediation program, if avail.
