The Court has considered the pleadings 16 and memoranda of the parties and other relevant matters of record and has made a review and 17 determination in accordance with the requirements of 28 U.S.C. § 636 and applicable case law, and 18 good cause appearing, the court hereby 19 20 ADOPTS AND ACCEPTS the Report and Recommendation of the United States Magistrate Judge (ECF #23). 21 IT IS HEREBY ORDERED that Defendants’ Motion to Dismiss (ECF #18) is GRANTED. 22 IT IS FURTHER ORDERED that Defendant State of Nevada is DISMISSED from this 23 24 action, the Clerk of the Court shall enter Judgment accordingly and close this case.
