ORDER - Respondents' # 22 motion to dismiss is denied without prejudice. Further ordered petitioner's ## 21 , 31 , 40 motions are denied without prejudice. Further ordered that # 7 order denying # 4 motion for appointment of counsel is vacated and the # 4 motion is granted. Counsel will be appointed to represent petitioner in all proceedings related to this matter. Further ordered that subject to confirmation of financial eligibility the FPD shall be provisionally appointed as counsel, and shall 30 days to undertake direct representation or indicate inability to do so. Further ordered that petitioner shall not file any further papers other than through counsel other than potentially the IFP application if same is mor e efficiently filed in pro per. Further ordered that hard copies of any additional state court exhibits shall be sent to the Reno Clerk's Office. Clerk shall send a copy of this order to the pro se petitioner the FPD, and the CJA Coordinator. ( Copy to P mailed 3/31/2014; E-service to FPD and Coordinator) Clerk shall further provide FPD with copies of all prior filings by NEF regeneration or other expedient means.
