The Complaint 15 alleges that the defendant U.S. Currency described in the caption, and all of such U.S. Currency, is 16 property which constitutes proceeds traceable to the exchange of controlled substances in violation 17 of Title II of the Controlled Substances Act (21 USC § 801, et seq.) or constitutes money furnished 18 or intended to be furnished by a person in exchange for a controlled substance or listed chemical in 19 violation of Title II of the Controlled Substances Act and is, therefore, subject to forfeiture to the 20 United States of America pursuant to 21 USC § 881(a)(6). 21 Process was fully issued in this action and returned according to law. 22 Pursuant to a Summons and Warrant of Arrest in Rem for the Property issued by this Court 23 on January 14, 2013, the United States Marshals Service arrested the defendant property on January 24 28, 2013. 25 26 Appropriate public notice of this forfeiture action and arrest was given to all persons and entities by publication of an appropriate notice via the official internet government forfeiture site, Case 3:12-cv-00656-RCJ-VPC Document 14-1 Filed 04/24/13 Page 2 of 2 1 www.forfeiture.gov, compliant with Rule G(4), Supplemental Rules for Admiralty or Maritime Claims 2 and Asset Forfeiture Actions. 3 Statutory notice of this action compliant with Rule G(4), Supplemental Rules for Admiralty 4 or Maritime Claims and Asset Forfeiture Actions, was given to known prospective claimants, 5 including James Hoffman. 6 7 A verified claim was filed on January 25, 2013, by James Hoffman. On April 17, 2013, the verified claim of James Hoffman was withdrawn. 8 Other than the claim by James Hoffman which was subsequently withdrawn, no claim, answer, 9 or other responsive pleading has been filed on behalf of any person. Default was entered on April 24, 10 2013, of the defendant funds, specified individuals and entities, and all other persons or entities who 11 claim an interest in the defendant property. 12 Now, therefore, good cause appearing, it is hereby ORDERED, ADJUDGED, AND 13 DECREED that Judgment be and is entered against the defendant 14 $35,000.00 IN UNITED STATES CURRENCY 15 and against all persons and/or entities, having any interest in such property and that the defendant 16 property be, and the same is, hereby forfeited to the United States of America and no right, title, or 17 interest in the defendant property shall exist in any other party. The defendant property shall be 18 disposed of according to law. 19 20 21 This 23rd day of August, 2013.
