On May 17, 2013, this 16 court dismissed plaintiff’s complaint with prejudice and without leave to amend for failure to state a 17 claim for which relief may be granted (ECF #3). Plaintiff filed a notice of appeal on June 6, 2013 (ECF 18 #6). 19 On June 10, 2013, the Ninth Circuit Court of Appeals referred this matter to this court 20 for the limited purpose of determining whether in forma pauperis status should continue for the appeal 21 or whether the appeal is frivolous or taken in bad faith (ECF #9). Accordingly, this court certifies that 22 any in forma pauperis appeal from its order would not be taken “in good faith” pursuant to 28 U.S.C. 23 § 1915(a)(3). See Coppedge v. United States, 369 U.S. 438, 445 (1962); Gardner v.
