The Court has considered the pleadings and memoranda of the parties and other relevant matters 16 of record and has made a review and determination in accordance with the requirements of 28 U.S.C. 17 § 636 and applicable case law, and good cause appearing, the court hereby 18 19 ADOPTS AND ACCEPTS the Report and Recommendation of the United States Magistrate Judge (ECF #25). 20 21 IT IS HEREBY ORDERED that Plaintiff’s Motion for Remand and/or Reversal (#16) is DENIED. 22 IT IS FURTHER ORDERED that Defendant’s Cross-Motion to Affirm (#20) is GRANTED 23 IT IS SO ORDERED this 6th day of June, 2014. 24 25 26 _______________________________ ROBERT C.
