(THIRD REQUEST) 15 16 Respondents move this Court for an enlargement of time of thirty days from the current due date 17 of Friday, September 4, 2020 up to and including Monday, October 5, 2020, in which to file their answer 18 to Petitioner Michael Smith’s Second Amended Petition for Writ of Habeas Corpus. ECF No. 44. This 19 motion is made pursuant to Fed. R. Civ. P. 6(b) and Rule 6-1 of the Local Rules of Practice and is based 20 upon the attached affidavit of counsel. 21 22 23 24 25 26 27 This is the third enlargement of time sought by Respondents and is brought in good faith and not for the purpose of delay. I am an attorney licensed to practice law in all courts within the State of Nevada and am 6 employed as a Senior Deputy Attorney General in the Office of the Nevada Attorney General. I have 7 been assigned to represent Respondents in the case of Smith v. Baker, 3:13-cv-00246-RCJ-WGC, and as 8 such, have personal knowledge of the matters contained herein. 9 2. An answer to the Second Amended Petition for Writ of Habeas Corpus (ECF No. 44) is 10 currently due on Friday, September 4, 2020. Respondents have been unable to timely complete their 11 answer and need additional time. Respondents seek an extension of thirty days up to and including 12 Monday, October 5, 2020. 13 3. Respondents understand that this is an older case that needs to be prioritized and that it is 14 unusual for this Court to grant another extension without good cause. However, I had a family member 15 who became ill with Covid-19. Due to my exposure to him, I was also under quarantine and unable to go 16 into the office to review some of the necessary exhibits in this matter. His care, which included emergency 17 room visits, and an extended hospital stay, as well as testing protocols for myself and other family 18 members took me away from work for several days during the month of August. This had a ripple effect, 19 as matters due during that period got pushed back. The last of those items, a Ninth Circuit answering 20 brief in Minor v. Williams, Case No. 19-15822 due on August 17, 2020 was pushed to September 2, 2020. 21 Unfortunately, that left insufficient time to complete the answer in this matter by September 4, 2020. 22 Consequently, Respondents are seeking an additional extension of thirty days to complete the answer. 23 24 4. Respondents have conferred with counsel for Petitioner about this request and Petitioner’s counsel does not object to the requested extension. 25 5. This is the third request for an extension. 26 6.
