The Court determines that the Magistrate Judge’s 19 Report and Recommendation (#8) entered on October 31, 2014, should be ADOPTED AND 20 ACCEPTED. 21 IT IS HEREBY ORDERED that Plaintiff’s Application to Proceed in Forma Pauperis (#1) be 22 granted and the Clerk of the Court file the Complaint. 23 IT IS FURTHER ORDERED that this action is DISMISSED WITH PREJUDICE. 24 IT IS FURTHER ORDERED that all pending motions are DENIED as MOOT. 25 IT IS SO ORDERED. 26 DATED: this 2nd day of January, 2015. 27 28 _____________________________________ ROBERT C.
