ADOPTS AND ACCEPTS the Report and Recommendation of the United States

Magistrate Judge (ECF #18).

IT IS HEREBY ORDERED that this action is DISMISSED without prejudice. The Clerk

of the Court shall enter judgment accordingly and close this case.
