IT IS HEREBY ORDERED that Defendant Deeds Motion for Summary Judgment (ECF No. 48 ) is GRANTED. IT IS FURTHER ORDERED that Defendants' Motion for Summary Judgment (ECF No. 53 ) is GRANTED. And, the Report and Recommendation of the 13 United States Magistrate (ECF No. 62) entered on May 22, 2017, in which the Magistrate Judge 14 recommends the Court grant Defendants’ Motion for Summary Judgment (ECF No. 53). The Court 15 has considered the pleadings and memoranda of the parties and other relevant matters of record and 16 has made a review and determination in accordance with the requirements of 28 U.S.C. § 636 and 17 applicable case law, and good cause appearing, the court hereby 18 ADOPTS AND ACCEPTS the Report and Recommendation of the United States 19 Magistrate Judge (ECF Nos. 60, 62). 20 IT IS HEREBY ORDERED that Deeds’ Motion for Summary Judgment (ECF No. 48) is 21 GRANTED. 22 IT IS FURTHER ORDERED that Defendants’ Motion for Summary Judgment (ECF No. 23 53) is GRANTED.
