(ECF 16 No. 1, 1-1). On April 27, 2015, Plaintiff filed a motion for leave to file an amended complaint. 17 (ECF No. 3). In that motion, Plaintiff submitted pages that he wanted this Court to attach to 18 the end of his original complaint. (Id. at 1). The Court grants Plaintiff’s motion for leave to file 19 an amended complaint but denies the attachments. 20 Plaintiff is granted leave to file an amended complaint. However, Plaintiff is advised 21 that an amended complaint supersedes the original complaint and, thus, the amended 22 complaint must be complete in itself. See Hal Roach Studios, Inc. v. Richard Feiner & Co., 23 Inc., 896 F.2d 1542, 1546 (9th Cir. 1989) (holding that “[t]he fact that a party was named in the 24 original complaint is irrelevant; an amended pleading supersedes the original”); see also 25 Lacey v. Maricopa Cnty., 693 F.3d 896, 928 (9th Cir. 2012) (holding that for claims dismissed 26 with prejudice, a plaintiff is not required to reallege such claims in a subsequent amended 27 complaint to preserve them for appeal). Plaintiff’s amended complaint must contain all claims, 28 defendants, and factual allegations that Plaintiff wishes to pursue in this lawsuit. The Court 1 will not piecemeal multiple filings in the docket to determine which claims, defendants, and 2 allegations Plaintiff wishes to pursue. 3 document that he seeks to use as his amended complaint. Plaintiff must file the amended 4 complaint on this Court’s approved prisoner civil rights form and it must be entitled “Second 5 Amended Complaint.” 6 II. 7 8 As such, Plaintiff must file one comprehensive CONCLUSION For the foregoing reasons, IT IS ORDERED that Plaintiff’s motion for leave to file amended complaint (ECF No. 3) is granted in part and denied in part. 9 IT IS FURTHER ORDERED that if Plaintiff chooses to file an amended complaint, 10 Plaintiff shall file the amended complaint within 30 days from the date of entry of this order. 11 IT IS FURTHER ORDERED that the Clerk of the Court shall send to Plaintiff the 12 approved form for filing a § 1983 complaint, instructions for the same, and a copy of his 13 original complaint (ECF No. 1-1) and “amended complaint” (ECF No. 3, 4).
