POLK, 5 CASE NO.: 3:15-CV-00488-RCJ-WGC Plaintiff, ORDER 6 v. 7 MIRANDA DU, et al., 8 Defendant. _______________________________________ 9 10 Before the Court is the Report and Recommendation of U.S. Magistrate Judge (#61) entered on 11 March 4, 2016, recommending that the Court grant Plaintiff’s Application to Proceed In Forma Pauperis 12 (ECF #1), file the Complaint (ECF #1-1), dismiss this action with prejudice and denying as moot motions 13 (ECF #3-4). On March 14, 2016, Plaintiff filed his Objections to the Magistrate Judge’s Report and 14 Recommendation (ECF #7). 15 The Court has conducted it’s de novo review in this case, has fully considered the objections of 16 the Plaintiff, the pleadings and memoranda of the parties and other relevant matters of record pursuant 17 to 28 U.S.C. § 636(b)(1)(B) and Local Rule IB 3-2. The Court determines that the Magistrate Judge’s 18 Report and Recommendation (#6) entered on March 4, 2016, should be ADOPTED AND ACCEPTED. 19 IT IS HEREBY ORDERED that Plaintiff’s Application to Proceed In Forma Pauperis (ECF #1) 20 is GRANTED. 21 IT IS FURTHER ORDERED that Motions (ECF #3-4) are DENIED as moot. 22 IT IS FURTHER ORDERED that this action is DISMISSED WITH PREJUDICE. The Clerk 23 of the Court shall enter judgment accordingly and close the case. 24 IT IS SO ORDERED this 26th day of April, 2016. 25 26 _____________________________________ ROBERT C.
