The Court has considered the Report and Recommendation of United States Magistrate

(ECF #27) entered on January 17, 2017 in which the Magistrate Judge recommends the Court grant

Plaintiff’s Motion to Voluntarily Dismiss this case (ECF No. 25). The Court has considered the
12
pleadings and memoranda of the parties and other relevant matters of record and has made a review
13
and determination in accordance with the requirements of 28 U.S.C. § 636 and applicable case law,
14
and good cause appearing, the court hereby
15
ADOPTS AND ACCEPTS the Report and Recommendation of the United States
16
Magistrate Judge (ECF No. 27).

IT IS HEREBY ORDERED that Plaintiff’s Motion to Voluntarily Dismiss (ECF No. 25)
18
is GRANTED. The Clerk of the Court shall close this case.
