COMES NOW Plaintiff, BANK OF AMERICA, N.A., and Defendants, THUNDER

PROPERTIES, INC. and LVDG, LLC [SERIES 109], by and through their undersigned counsel,

and hereby stipulate and agree as follows:

On November 30, 2017, Plaintiff filed a Motion for Summary Judgment herein
24
[ECF #55]. Responses are presently due on December 21, 2017.

Defendants’ counsel has been required to devote time and attention to numerous
26
other pending legal matters since the filing of the Motion for Summary Judgment
27
which have detracted from the time available prepare a response. Specifically,

Defendants’ counsel has responded to approximately 15-20 summary judgment

motions that have been filed in various cases over the course of the past several
3
weeks. In addition, Defendants’ counsel has had several appellate briefs due

within the past several weeks and coming weeks.

Based upon the foregoing, Defendants have requested and shall be granted an
extension of time until January 26, 2018, in which to respond to the Plaintiff’s

Motion for Summary Judgment.

For reasons similar to those set forth above, Plaintiff desires an extension of time

in which to file any Reply to Defendants’ Response. To that end, Plaintiff has

requested and shall be granted an extension of time until February 16, 2018, in

which to file its Reply to Defendants’ Response to Motion for Summary

Judgment.
