IT IS HEREBY AGREED AND STIPULATED, that the deadline for the HOA and

KERN to respond to BANA’s Motion for Partial Summary Judgment shall be extended to

3

January 15, 2018. The current deadline is on January 3, 2018. Accordingly, BANA’s

4

Reply shall be due on January 29, 2018.

Pursuant to Local Rule 6-1(b), the Parties state the reason for the extension is
due to the fact counsel for the HOA and KERN require additional time to review and

analyze the arguments raised in BANA’s Motion for Partial Summary Judgment, and in

9

view of the upcoming holidays the parties have entered into this agreement in good faith

10

and not for purposes of delay. This is the Parties’ first request for an extension, and is

11

made in good faith and not for purpose of delay.
