ADOPTS AND ACCEPTS the Report and Recommendation of the United States

IT IS HEREBY ORDERED that Plaintiff’s Complaint is DISMISSED WITH
PREJUDICE.
IT IS FURTHER ORDERED that Plaintiff’s Application for Leave to Proceed In
Forma Pauperis (ECF No. 1) is DENIED as MOOT.
