The Court has considered the pleadings and memoranda 14 of the parties and other relevant matters of record and has made a review and determination in 15 accordance with the requirements of 28 U.S.C. § 636 and applicable case law, and good cause 16 appearing, the court hereby 17 ADOPTS AND ACCEPTS the Report and Recommendation of the United States 18 Magistrate Judge (ECF No. 3). 19 IT IS HEREBY ORDERED Plaintiff’s Application to Proceed In Forma Pauperis (ECF 20 No. 1) is GRANTED. 21 IT IS FURTHER ORDERED that the Clerk of the Court shall file Plaintiff’s Complaint 22 (ECF No. 1-1). 23 IT IS FURTHER ORDERED that this action is DISMISSED WITH PREJUDICE. 24 IT IS FURTHER ORDERED that the Clerk of the Court shall close this case. 25 IT IS SO ORDERED this 22nd day of August, 2017. 26 _______________________________ ROBERT C.
