CADISH, et al., 12 Respondents. 13 14 Petitioner John B. Odoms has submitted a petition for a writ of mandamus (ECF 15 No. 1-1). His application to proceed in forma pauperis (ECF No. 1) shall be granted. 16 Odoms asks this court to direct the Eighth Judicial District Court of Clark County, 17 Nevada—which has declared petitioner a vexatious litigant—to allow him to file a motion 18 for modification of sentence. However, this court lacks jurisdiction to issue a writ of 19 mandamus to a state court. Demos v. United States Dist. Court for the E. Dist. of 20 Wash., 925 F.2d 1160, 1161 (9th Cir. 1991). Accordingly, this petition is dismissed for 21 lack of jurisdiction. The court will not issue a certificate of appealability, as reasonable 22 jurists would not debate the dismissal of this petition. 23 24 25 26 IT IS THEREFORE ORDERED that petitioner’s application to proceed in forma pauperis (ECF No. 1) is GRANTED.
