ORDER pursuant to ECF No. 6 screening order; this action shall proceed against Defendants Baca, Ward and Powers on Count III; case stayed until 1/31/2019 to allow parties to settle their dispute before filing fee is paid; AG must file the report regarding the results of the 90 day stay; settlement may or may not include payment of money damages; if the case does not settle, Plaintiff will be required to pay the full $350 filing fee; if any party seeks exclusion from inmate mediat ion program, that party must file a motion to exclude case from mediation by 11/23/2018; Clerk directed to electronically serve a copy of this order, ECF No. 6 screening order and a copy of plaintiff's complaint on the AG (E-service and NEF regenerated on 11/2/2018); AG to advise the Court by 11/23/2018 whether it will enter a limited notice of appearance on behalf of Defendants for purpose of settlement.
