The Court has considered the Report and Recommendation of United States Magistrate

(ECF No. 4) entered on January 30, 2018, in which the Magistrate Judge recommends the Court grant
11
Plaintiff’s IFP application (ECF No. 1), file the Complaint (ECF No. 1-1) and dismiss the Complaint
12
with prejudice.
The Court has considered the pleadings and memoranda of the parties and other
13
relevant matters of record and has made a review and determination in accordance with the
14
requirements of 28 U.S.C. § 636 and applicable case law, and good cause appearing, the court hereby
15
ADOPTS AND ACCEPTS the Report and Recommendation of the United States
16
Magistrate Judge (ECF No. 4).
17
IT IS HEREBY ORDERED that Plaintiff’s IFP Application (ECF No. 1) is GRANTED,
18
the Clerk of the Court shall file the Complaint (ECF No. 1-1).
19
IT IS FURTHER ORDERED that the Complaint is DISMISSED WITH PREJUDICE. The
20
Clerk of the Court shall close the case.
