Petitioner has submitted an application to proceed in forma pauperis (ECF No. 1)

and a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. In an attached
14
letter, petitioner states that he owes more than $1,400. However, the statement of his
15
account shows that he receives deposits regularly, that he is able to make purchases at
16
the prison’s commissary, and that he has enough money in his account to pay the full
17
filing fee of five dollars ($5.00).

It is therefore ordered that the application to proceed in forma pauperis (ECF No.
19
1) is denied. Petitioner will have thirty (30) days from the date that this order is entered to
20
have the filing fee of five dollars ($5.00) sent to the Clerk of the Court. Failure to comply
21
will result in the dismissal of this action.

It is further ordered that the Clerk of the Court send petitioner two (2) copies of this
23
order. Petitioner is ordered to make the necessary arrangements to have one (1) copy of
24
this order attached to the check paying the filing fee.
