ORDER - IT IS ORDERED the Clerk of the Court shall SEND Wood the approved form application to proceed in forma pauperis by a non-inmate. (Mailed 4/15/2024). IT IS FURTHER ORDERED that on or before May 15, 2024, Wood will either: (1) pay the full $405 filing fee for a civil action (which includes the $350 filing fee and the $55 administrative fee); or (2) file with the Court a completed Application to Proceed in Forma Pauperis for Non-Inmate on this Courts approved form, along with a completed and signed financial affidavit. ORDER TO PAY FILING FEE OR FILE APPLICATION TO PROCEED IN FORMA PAUPERIS KEVIN EIKENBERRY, 8 Defendant. 9 10 On April 12, 2024, Plaintiff Andrea Wood (“Wood”) submitted a civil rights 11 complaint under 42 U.S.C. § 1983. (ECF No. 1-1). Wood has neither paid the full $402 12 filing fee for this matter nor filed an application to proceed in forma pauperis. 13 Under Local Rule LSR 1-1, a person who is unable to prepay the fees in a civil 14 case may apply to the Court for leave to proceed in forma pauperis. The application must 15 be made on the form provided by the Court and must include a financial affidavit 16 disclosing the applicant’s income, assets, expenses, and liabilities. 17 18 Accordingly, IT IS ORDERED the Clerk of the Court shall SEND Wood the approved form application to proceed in forma pauperis by a non-inmate. 19 IT IS FURTHER ORDERED that on or before May 15, 2024, Wood will either: (1) 20 pay the full $405 filing fee for a civil action (which includes the $350 filing fee and the $55 21 administrative fee); or (2) file with the Court a completed Application to Proceed in Forma 22 Pauperis for Non-Inmate on this Court’s approved form, along with a completed and 23 signed financial affidavit. Failure to do so will result in a recommendation to the District 24 Court to dismiss the complaint. 25 The Court will retain Wood’s civil rights complaint, (ECF No. 1-1), but will not file it 26 unless and until Wood timely complies with this order. 27 April 15, 2024 DATED: __________________ 28 UNITED STATES MAGISTRATE JUDGE
