The Coca-Cola Company, et al., Civil No. 07-828 (NLH) Dear Mr. Cuker: I received plaintiff's Motion for Order Setting a Pretrial Conference. [Doc. No. 22]. This Letter Order serves to grant the Motion. I am scheduling a Rule 16 Scheduling Conference in this matter on July 30, 2007 at 2:00 p.m. You will receive a copy of the Court's Order for Scheduling Conference in a separate communication. The parties are directed to meet and confer and submit to the Court no later than July 27, 2007 a proposed discovery schedule. I also direct plaintiff's attention to the matter of Melfi v. The Coca-Cola Company, et al., C.A. No. 07-828 (NLH). I ask all parties in this case and Melfi to send me letter briefs by July 27, 2007, regarding whether the two (2) cases should be consolidated for discovery and case management purposes. Counsel in Melfi are welcome but are not required to attend the July 30, 2007 conference. I also direct the parties to L. Civ. R. 26.1(d) regarding the duty to meet and confer regarding electronic discovery issues. See also L. Civ. R. 16.1(g)(1)(case management motions must be accompanied by an affidavit certifying that the moving party has conferred with the opposing party in a good faith effort to resolve by agreement the issues raised by the motion without the intervention of the Court and that the parties have been unable to reach agreement).
