Antoine's m o tio n for reconsideration of this Court's denial of his application to proceed without p re p a ym e n t of fees under 28 U.S.C. § 1915; and this Court having denied Plaintiff's re q u e s t to proceed in forma pauperis given Plaintiff's representation that he retained an a tto rn e y and paid that attorney $3,400 in connection with this case; and Plaintiff re p re se n tin g in his motion for reconsideration that his home is in foreclosure but having f a ile d to provide any documentation to substantiate this claim; and Plaintiff instead h a v in g appended to his motion for reconsideration three affidavits of service, which d e m o n s tra te that Plaintiff used funds to hire a process server in Arizona for this action; a n d the payment of $3,400 to an attorney and the retention of a process server indicating to the Court that Plaintiff does not qualify to proceed in forma pauperis for the purpose of th is action; and for good cause appearing, IT IS on this 26th day of April 2010, hereby, O R D E R E D that Plaintiff's motion for reconsideration is DENIED. /s/ William J.
