MEMORANDUM OPINION and ORDER that this petition for writ of habeas corpus is recharacterized as a petition for writ of habeas corpus pursuant to 28:2254; that Petitioner shall have 45 days from the date he received this Order to file a letter with th e Clerk advising how he would like to proceed; that is Petitioner does not file a signed response within 45 days the Court will rule on the Application as is; that Petitioner's application to proceed in forma pauperis is granted and the Clerk shall file the Petition; that Petitioner's motions to amend (d.e. 2 and 4 ) shall be granted as a matter of right; the motion for writ of mandamus (d.e. 3 ) is DENIED.
