This matter having come before the Court on the parties’ Unopposed Joint Motion to Amend
Scheduling Order [Doc. No. 100], and the Court being advised that the Motion is jointly made and
unopposed, it is hereby
ORDERED that the Court’s June 1, 2011 Scheduling Order is amended as follows:
The Court enters the following amended discovery plan:
File Responsive Claim Construction Brief due July 25, 2011.
File Reply Claim Construction Brief due Sept. 23, 2011 (not to exceed 7 pages, and
limited to issues raised for the first time in the Responsive Claim Construction Brief or expert
depositions).
Claim Construction Hearing to be set by Presiding Judge.
Fact Discovery Cutoff due 90 days after ruling on claim construction.
Exchange Initial Expert Reports on which party bears the burden of proof due 30
days
after fact discovery cut off.
Exchange Responsive Expert Reports due 60 days after fact discovery cut off.
Expert Discovery Cutoff due 90 days after fact discovery cut off.
Deadline to File Dispositive Motions and Daubert motions due 45 days after expert
discovery closes.
IT IS SO ORDERED.
