Intel Corporation, CIV 10-1077 RB/WDS Dear Counsel: On May 8, 2012, I issued a Memorandum Opinion and Order granting in part and denying in part Intel’s Motion for Summary Judgment of Unenforceability. In order to ensure that this case progresses in a timely manner, I anticipate setting a claims construction hearing for July 2, 2012. However, given that my Order left certain issues outstanding, I ask counsel to confer with one another and provide the Court with an update on the following issues by Friday, June 1, 2012: 1. 2. Joinder of Sandia Corporation as a party in the instant action; Development of the factual record regarding Sandia Corporation’s ownership interest in Patent ’321; 3. Progress of settlement discussions. The Court will finalize the date of the Markman hearing following receipt of this update.
