ORDER ADOPTING REPORT AND RECOMMENDATION: Having conducted a de novo review of the record, and for the reasons stated, the court adopts the 2007 R&R in its entirey, and orders that, pursuant to Rule 41(b) of the FRCP, this case be dismissed with prejudice for failure to prosecute.
