MEMORANDUM AND ORDER: The court thus concludes that, even assuming that Plaintiffs were deprived of constitutionally protected property and liberty interests, they recieved all of the process to which they were entitled. Additionally, the court concl udes that the Department acted within its statutory aurthority. Because their is no basis for liability on the part of the Department, there is no basis for liability on the part of individual Defendants. See Demoret v. Zegarelli, 451 F .3d 140, 148 (2d Cir. 2006). Accordingly, Defendants' motions for summary judgment are GRANTED and Plaintffs' motions for summary judmgent are DENIED. Plaintiffs' claims are dismissed with prejudice. Ordered by Judge Nicholas G. Garaufis on 2/18/2010. Fwded for judgment. (Abdallah, Fida)
