MEMORANDUM AND ORDER: The instant action shall proceed solely with regard to pltf.'s claim against the U.S. Dept. Dept. of Education. The U.S. Dept. of the Treasury shall be deleated from the caption. The Clerk of Court shall issue a summons sol ely naming the U.S. Dept. of Education of Deft. The U.S. Marshalls Service shall serve the summons, the original complaint, the Court's order of 4/25/06, this Order, the amended complaint, and the "Request for Clarification" on the de ft, the U.S. Attorney for the Eastern District, and the Attorney General of the U.S. without payment of fees. All further pretrial proceedings in this matter as referred to USMJ Bloom. Ordered by Judge Eric N. Vitaliano on 4/28/06. (Permaul, Jenny)
