MEMORANDUM AND ORDER, accordingly, the Court concludes that removal should not be permitted and the action is hereby remanded, pursuant to 28 USC sec. 1447 (c), to the Civil Court of the City of New York, County of Queens, Housing Part. The Clerk of the Court is directed to immediately send a certified copy of this Order to the Clerk of the Civil Court of the City of New York, County of Queens, Housing Part, and to close this case. The Court certifies pursuant to 28 USC sec. 1915(a)3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
