REPORT AND RECOMMENDATIONS re #34 #37 : The Court hereby recommends that defendants' motion for summary judgment be granted as to all claims with the exception of those arising under the TVPA; that defendants' motion for an adverse inference as a sanction for the spoliation of evidence be granted in the event that the district court denies the motion for summary judgment, that defendants' motion for attorneys' fees as a sanction for the spoliation of evidence be granted; and that plaintiff's motion to delay consideration of the defendants' motion to allow him to conduct further discovery be denied.
