MEMORANDUM AND ORDER: Because the parties entered into an enforceable agreement to arbitrate and because the claims that Pltffs assert fall within its scope, Hogue's motion for the enforcement of the Arbitration Clause is GRANTED. Pltffs' claims against Hogue are stayed pursuant to Section 3 of the FAA. Hogue's motions to dismiss and for summary judgment are DENIED. Ordered by Judge Nicholas G. Garaufis on 3/4/2010.
