MEMORANDUM AND ORDER: Since Plaintiffs submissions are insufficient to establish that defendant was properly served with process under either Maryland or New York law, this Court cannot conclude that defendant has failed to plead or otherwise defend, and cannot enter a default against defendant; This Court will, however, grant plaintiff leave to either (1) amend her motion for entry of default in order to show that Ms. Smiths service was adequate or (2) re-serve defendant. Plaintiff must amend h er motion or re-serve defendant on or before September 14, 2009. If plaintiff fails to comply with this Order within the time provided, this case will be dismissed pursuant to Fed. R. Civ. P. 4(m).. Ordered by Judge Sandra L. Townes on 8/24/2009.
