Talavera v. Astrue

Filing 26

OPINION AND ORDER. The court recognizes the significant burden placed on ALJs who are charged not only with reaching independent, informed decisions on the basis of often complicated records, but also with fully developing those records and protecti ng the rights of claimants. The task is difficult and the court recognizes the diligent and thorough work performed by the ALJ in this case. Nevertheless, for the above stated reasons, the defendant's motion for judgment on the pleadings is de nied and the case is remanded to the Commissioner for further proceedings consistent with this opinion. Plaintiff's motion to remand solely for a calculation of benefits is also denied. The Clerk of the Court is directed to enter judgment accordingly.. Ordered by Judge Allyne R. Ross on 8/18/2010.
