ORDER: It is before me on 31 plaintiff's First Motion for Reconsideration of the Court's Order granting summary judgment. For the reasons that follow, the motion is GRANTED in part and DENIED in part. The Court grants reconsideration of its prior Order and finds that defendants are entitled to summary judgment on grounds other than those upon which the Court previously relied. SO ORDERED.
