ORDER (ADOPTING REPORT AND RECOMMENDATION): I hereby adopt 11 Report and Recommendation, in its entirety, as the opinion of the Court pursuant to 28 U.S.C. § 636(b)(1). Therefore, the Court awards plaintiff HSBC Bank USA, N.A. judgment against defendant A.T.A. Construction Corp. in the amount of $149,807.35, consisting of $129,583.00 in restitution and interest in the amount of $20,244.35 for the period from 8/26/2007 through 5/20/2009, and additional interest at a daily ra te of $31.95 per day thereafter, until the entry of judgment.
