ORDER: Accordingly, plaintiffs' 45 motion to amend is granted in part and denied in part. The Clerk of Court shall file plaintiffs' 46 proposed second amended complaint. The named defendants, except for the Bronx County District Attorne y's Office, shall respond to the second amended complaint by 5/28/2010. Defendants shall respond to the amended complaint as they deem appropriate. Defendants' 49 motion to stay discovery pending the resolution of plaintiffs' motion to amend is denied as moot. However, the Court will consider any request to extend the discovery deadline once defendants respond to the second amended complaint. SO ORDERED.
