MEMORANDUM AND ORDER, Newton has failed to comply with the Court's order directing him to show cause why he should not be enjoined from any additional in forma pauperis petitions or documents with this Court challenging his 11/28/02 conviction o r the 9/28/07 denial of his habeas petition. Accordingly, and for the reasons set forth in this Court's 9/28/09 Order, he is hereby enjoined from filing any such petitions without first seeking leave of the Court. The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
