ORDER: The Court held an initial pretrial conference pursuant to Fed. R. Civ. P. 16 in this case on 12/14/2009. For the reasons stated on the record, plaintiff shall demonstrate that he has withdrawn his state court action against defendant by 1/28/ 2010. Any request to amend the complaint, including any request to join other parties, shall be made by 1/14/2010. The Court set 4/2/2010 as the deadline for the parties to complete all discovery. Before requesting the Court's assistance regard ing a discovery dispute, the parties must make a good faith effort to resolve the dispute with one another. If defendant intends to file a motion for summary judgment, defendant's counsel shall write to Judge Matsumoto by 5/3/2010 to request a premotion conference. SO ORDERED.
